These Terms of Use (“Terms”) govern the access to and use of the website https://ecocoreedge.com (“Website”) operated by ECOCORE EDGE SOLUTIONS PRIVATE LIMITED (“EcoCore”, “Company”, “we”, “us”, or “our”).

ECOCORE EDGE SOLUTIONS PRIVATE LIMITED operates as a subsidiary of PRASA INFOCOM AND POWER SOLUTIONS PRIVATE LIMITED.

Any unauthorized use, reproduction, imitation, or misuse of such trademarks or branding elements may constitute infringement under applicable trademark laws and may result in appropriate civil and/or criminal legal action.

 

Reverse Engineering Prohibition

Users expressly agree that they shall not, directly or indirectly:

  • reverse engineer, decompile, disassemble, or attempt to derive the underlying structure, design, or architecture of EcoCore products or technologies
  • analyze, study, or deconstruct system designs, specifications, or documentation for the purpose of replication or competitive use
  • derive or attempt to recreate any hardware, software, or infrastructure design based on information made available on the Website
  • eplicate, reproduce, or attempt to imitate the architecture of EcoCore™ modular micro data center systems

This prohibition applies to all aspects of EcoCore’s technology, including but not limited to modular micro data center designs, rack architecture, cooling systems, power management systems, monitoring platforms, and system integration methodologies.

Any attempt to reverse engineer, replicate, or otherwise misappropriate EcoCore technology shall constitute a violation of intellectual property rights and may result in civil and/or criminal legal action under applicable laws.

 

Technology Replication and Misappropriation Prohibition

Users shall not, directly or indirectly, copy, replicate, reproduce, imitate, or otherwise misappropriate EcoCore’s proprietary technologies, system designs, or technical methodologies, including but not limited to:

  • modular micro data center architecture
  • rack integration methodologies and configurations
  • power distribution, backup, and monitoring systems
  • cooling system design and integration architecture
  • infrastructure deployment models and implementation methodologies

Users further agree not to use any information obtained from the Website for the purpose of developing, manufacturing, or offering competing products or solutions that are substantially similar to EcoCore technologies.

Any unauthorized replication, commercial exploitation, or misuse of EcoCore’s proprietary technologies shall constitute a violation of intellectual property rights and may result in appropriate civil and/or criminal legal proceedings under applicable laws.

 

Confidentiality of Technical Information

Certain technical information, materials, and content made available on the Website may constitute proprietary, confidential, or commercially sensitive information belonging to EcoCore and/or its parent company.

  • enterprise IT and data center management teams

Such entities shall remain solely and independently responsible for ensuring that any deployment, installation, integration, or operation of EcoCore technologies complies with all applicable:

  • electrical and safety standards
  • environmental and site-specific requirements
  • telecommunications and regulatory frameworks
  • data center operational and industry standards

EcoCore shall not be responsible or liable for any operational failures, system malfunctions, regulatory non-compliance, performance issues, or damages arising from improper deployment, configuration, integration, or use of its products by third parties.

 

Third-Party Technology Integration

EcoCore solutions may be designed to integrate or operate in conjunction with third-party hardware, software, network equipment, or infrastructure components.

EcoCore does not warrant or guarantee compatibility, interoperability, or performance with all third-party technologies or systems.

Accordingly, EcoCore shall not be responsible or liable for any failures, malfunctions, performance issues, or damages arising from or attributable to the use, integration, or operation of such third-party components or technologies.

 

Export Control and Regulatory Compliance

arising out of or in connection with the access to, use of, or inability to use the Website or any information contained therein.

Nothing in this clause shall exclude or limit liability to the extent such exclusion or limitation is not permitted under applicable law.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of laws principles.

Any interpretation of these Terms shall be made in accordance with applicable Indian laws.

 

International Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the use of the Website shall, as far as possible, be resolved amicably between the parties. A party intending to raise a dispute shall provide a written notice of at least fifteen (15) days to the other party, specifying the nature of the dispute.

If the dispute is not resolved within such period, it shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, including any statutory modifications or re-enactments thereof.

The arbitration shall be conducted by a sole arbitrator, to be mutually appointed by the parties.

The seat and venue of arbitration shall be Pune, Maharashtra, India, and the language of arbitration shall be English.

The arbitral award shall be final and binding on the parties.

 

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by any competent court, tribunal, or authority, such provision shall be deemed to be severed from these Terms to the extent of such invalidity or unenforceability.

The remaining provisions of these Terms shall continue in full force and effect and shall remain binding on the parties.

 

Modification of Terms

EcoCore reserves the right, at its sole discretion, to modify, amend, or update these Terms from time to time without prior notice, to reflect changes in legal requirements, business practices, or operational needs.

Any such modifications shall become effective upon publication on the Website, unless otherwise specified.

Users are encouraged to review these Terms periodically. Continued access to or use of the Website following any updates shall constitute the user’s acknowledgment and acceptance of the revised Terms.
